Debra Lafave: Probation Ended for Florida Teacher Guilty of Student Sex Scandal
Debra Lafave, the Florida teacher found guilty of a sex scandal with a 14-year-old student in 2004, ended her probation Thursday following a court ruling to terminate it early.
Judge Wayne Timmerman of Tampa ruled Thursday to end Lafave's probation sentence four years early, after Lafave asked to reduce her probation.
According to CNN, her lawyer, John Fitzgibbons, said Lafave, a new mother and living with her fiancé, has proven to be responsible and should not remain on probation until November 2015.
She is a new mom with all the responsibilities that come with twin boys, so she hopes to finally put this matter behind her and move on with her life, Fitzgibbons said during the hearing on Thursday.
Lafave, now 31-years-old, pleaded guilty in 2005 to having sex with a 14-year-old student while she was 23-years-old serving as a middle school teacher in Florida.
While the case never went to trial to protect the identity of the student, Lafave agreed in a last-ditch appeal to three years of house arrest and seven years of probation, and according to CNN, under the terms with no early termination of probation.
The ruling to terminate her probation, after serving two years of house arrest, effective immediately has outraged both the prosecutors as well as the unnamed victim's family.
We disagree with the judge's decision, spokesman for the Hillsborough County state attorney's office Mark Cox told CNN. We will seek relief at the appellate level.
The victim's sister told the Associated Press the victim, now 21-years-old, is still undergoing therapy.
I am absolutely positively against her getting early probation, the mother of the boy, who name remains anonymous, told ABC. Just because she had twins is a ridiculous excuse. And she's tired of probation? What type of excuse is that? Her actions have forever impacted our family.
Upon sentencing, Lafave was required by law to register as a sex offender and refrain from any contact with minors.
However, according to CNN, Lafave was tried in 2008 for violating her probation after hugging a 17-year-old coworker seeking sex-related advice about a boyfriend. The judge did not penalize Lafave, ruling the violation was not willful and substantial, though Lafave was aware the girl talk was a violation.
The ruling to end Debra Lafave's probation will now allow her to travel and dismiss her 10 p.m. to 6 a.m. curfew, according to the AP.
