Ariana Biermann Refused Breathalyzer And Blood Test During DUI Arrest: Police Report
Ariana Biermann allegedly refused to take a breathalyzer test during her DUI arrest. The daughter of singer Kim Zolciak-Biermann was arrested on suspicion of driving under the influence of alcohol after her Mercedes G-Wagon crashed with another car in Atlanta at around 1 a.m. Sunday.
According to the Forsyth County Sheriff's Office, the former "Real Housewives of Atlanta" star denied she was intoxicated during the arrest but admitted she had smoked a THC vape pen the night before.
The police report also noted that the 20-year-old "had a noticeable sway" during her field sobriety test and that there were clues that she was under the influence when the incident took place.
"I advised Ariana that I could smell the odor of an alcoholic beverage on her breath. She stated the odor was possibly from her clothing," stated an officer in the report. "Ariana stated she had smoked a THC vape pen the night before but did not drink."
"I conducted field sobriety evaluations with Ariana and observed signs of impairment. I observed that she had a noticeable sway during the evaluations," the officer added, noting that they also conducted a Horizontal Gaze Nystagmus (HGN) test on her and "observed four out of six clues" that she was intoxicated.
Ariana refused to provide a breath sample to the preliminary breath test after the arrest, the officer said. She also allegedly refused to take a blood test after initially consenting to it.
Cops seized Ariana's driver's license and booked her in Forsyth County Jail. She was charged with driving under the influence of alcohol, improper/erratic lane change, and underage possession/purchase of alcohol.
In a statement hours after the arrest, Ariana's lawyer Justin Spizman said the Georgia native was released on $5,120 bond and was planning to fight the charges against her.
"Despite Ariana's constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol. That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them," he said.
Hudson McLeroy, Ariana's boyfriend, was also arrested for DUI and furnishing alcohol to a minor.
