Erika Jayne and her lawyer husband, Tom Girardi, are facing legal charges for allegedly using their divorce to embezzle money.
A complaint was filed in an Illinois federal court Wednesday by law firm Edelson PC on behalf of several families who lost their loved ones from the Boeing plane crash in 2018. They sued Tom, 81, and Erika a.k.a. Erika Jayne, 49, for allegedly embezzling funds meant for the surviving families of the Lion Air Flight 610 victims.
"Tom has resorted to embezzling the proceeds of settlements that should have been directed to his clients — including, as the basis for this Complaint, the widows and orphans who lost loved ones in the tragic crash of Lion Air Flight 610 — in order to continue funding his and Erika’s lavish Beverly Hills lifestyles," the document obtained by People read.
The lawsuit also claimed that Tom's firm, Girardi & Keese (GK), is "on the verge of financial collapse and locked in a downward spiral of mounting debts and dwindling funds.”
"At the heart of this deception is Defendant Girardi and his need to fund outrageous lifestyles for himself and his soon-to-be ex-wife, Erika Jayne," the lawsuit stated.
It also alleged that the couple only divorced to protect their finances. It was reportedly Tom's first attempt to "hide and divert assets.
"While Erika publicly filed for divorce this month, on information and belief, that ‘divorce’ is simply a sham attempt to fraudulently protect Tom’s and Erika’s money from those that seek to collect on debts owed by Tom and his law firm GK," the suit added.
The lawsuit pointed out the couple's "lavish lifestyle" and how Erika allegedly said her looks cost $40,000 a month. The court document also mentioned her song, “Exxpen$ive."
"The Real Housewives of Beverly Hills" star filed for divorce from her husband of 21 years in November. In her filing, she asked the court to award her spousal support, Page Six reported.
Edelson PC and Erika declined to comment on the case, according to People. Tom also did not respond when asked for comment, according to the outlet.
Meanwhile, Erika shared a snap of her on Instagram wearing a sophisticated black outfit. "High drama," she wrote in the caption.
