Kate Upton ‘Furious’ Victoria’s Secret Used Her Photo In Catalog Without Permission: REPORT
It’s hard to imagine the always-smiley Kate Upton being “furious,” but that’s reportedly how the buxom model feels after Victoria’s Secret used photos of her without her permission.
According to the New York Post’s Page Six, the lingerie giant used an image of Upton for its most recent catalog without the model’s consent. Victoria’s Secret circulated a catalog with Upton modeling a black “Body by Victoria” bra on its back page, which circulated online Tuesday.
The image, however, is from two years ago and Upton is “furious” the old photo was used without a contract. “The pictures are from 2011," an unnamed source told Page Six. "Kate's not currently contracted to work with Victoria's Secret, and they didn't contact her before they used these images."
Upton, though, probably can't sue since Victoria’s Secret likely owns the images. Business Insider pointed out that the model might not take legal action since the lingerie company likely did a buyout of the images, giving them unlimited use of the old photos. The brand confirmed to the Huffington Post that the photo from the latest catalog "is from a previous shoot” but didn't mention the fine print of the contract.
Aside from the contractual issue, Upton is likely infuriated after Victoria’s Secret model booker Sophia Neophitou told the New York Times that the brand would never allow the curvy Upton to walk in its famous fashion show.
“We would never use” Upton, Neophitou said in 2012, calling the blonde model “too obvious.” “She’s like a Page 3 girl,” she said, referencing British tabloid the Sun’s feature about hot women. “She’s like a footballer’s wife, with the too-blond hair and that kind of face that anyone with enough money can go out and buy.”
Neophitou, however, appears to be alone in her opinion since Upton hasn't only been the Sports Illustrated Swimsuit Edition cover model two years in a row, but has landed three Vogue covers and campaigns with countless brands including Mercedes-Benz. The 20-year-old model has also covered V Magazine, Harper’s Bazaar and Muse and walked the runway for the 2012 Beach Bunny Swimwear show and Liverpool Interlomas during Liverpool Fashion Fest 2012.
