Kris Humphries and Kim Kardashian’s Annulment / Divorce May Get Stalled Until 2013

Although Kris Humphries and Kim Kardashian seemed to waste no time when they separated very publicly last year after only 72 days of marriage, legally divorcing is not proving as easy for them.

The erstwhile couple, who filed for divorce on Oct. 31, 2011, are reportedly still locked in a legal battle and are now expected to be unable to finalize their divorce, or possibly annulment, until at least next year. Lawyers for both Kardashian and Humphries appeared at a hearing Wednesday morning before a judge, to disclose what they have each done so far to settle the case or prepare for trial.

According to reports from the Associated Press, the holdup is coming from Humphries' team, which plans to prove that the marriage was a reality TV sham by deposing 33 witnesses.

Marshall Waller, the divorce attorney for Humphries, claims that the Kardashians have made the discovery process difficult for him by not being forthcoming with records. "I don't want to use the word 'uncooperative,' but they are not making the process easier," Waller told the judge.

"I'm not going to depose Ms. Jenner [Kardashian's mother] until I get the business records," he said. "I'm trying to get information."

In the meantime, Humphries' side has gotten creative about obtaining that information. Kardashian's lawyer, Laura Wasser, complained that Humphries' team, which would like to depose Kanye West, sent a process server to Kardashian's home with a Nordstrom box, in which was cleverly hidden a witness subpoena for West. Wasser said that she did not understand why the process server was necessary, when Waller could have easily gotten the name of West's attorney from her.

Wasser went on to complain about the nonresponsive behavior on the part of the Humphries' team, blaming them for unnecessarily prolonging what should have been a quick process, and incurring exorbitant legal fees upon her client. At this point, Kardashian has already racked up $250,000 in attorney fees, Wasser told the judge.

"It's expensive," said Wasser, who added that she intended to ask for all of those fees to be paid by Humphries. "And I'm at a loss to figure out what the holdup is. They had a prenup and were married 72 days." Wasser left the court saying, "We're just moving forward. My client just wants to be divorced."

Kardashian and Humphries have both moved on since separating. Kardashian has taken her relationship with rapper Kanye West very public in the last few months, sparking rumors that they plan to marry. Humphries has a girlfriend as well, who will also be deposed in the trial.
