Since Jennifer Dulos' May 24 disappearance, legal troubles have continued to follow her husband Fotis Dulos. As police have continued to investigate his potential involvement in the New Canaan resident's whereabouts, he has been in and out of court for various issues. At this time, both he and his one-time girlfriend, Michelle Troconis, have been charged with evidence tampering and hindering prosecution.

In late 2019, Fotis started seeking to have his divorce case dismissed in an attempt to move the ongoing battle for guardianship of his five children over to the juvenile court, as reported by the Hartford Courant. Both he and Jennifer had been removed as guardians and custody had been legally turned over to his mother-in-law, Gloria Farber. Rick Rochlin, who is serving as Fotis' attorney, stated in a motion that his client plans on appealing the ruling to juvenile court.

Now, the attorney who is representing Jennifer in her ongoing two-year divorce is requesting that a judge throw out Fotis' attempt to have legal action dismissed.

"Failure to acknowledge that he is the prime suspect in his wife's disappearance can only be described as being akin to the defendant (Fotis Dulos) having a 'factual lobotomy' as to the inconvenient facts as to his apparent involvement in the plaintiff's (Jennifer Dulos) disappearance," attorney Rueben Midler wrote in a new response that was filed this week, as reported by the Stamford Advocate.

Aside from the aforementioned legal hurdles, Fotis has also been in and out of court for other issues surrounding his wife's disappearance. In September, he appeared to address the fact that he had not been properly charging his court-ordered GPS monitoring system. Additionally, he has also appealed his gag order, which eventually moved the case to the Connecticut Supreme Court.

A new hearing is scheduled for Jan. 9 in Stamford, Connecticut, in regards to the ongoing custody battle, which is the same day that Fotis is also scheduled to appear for his next pretrial hearing regarding his criminal charges.
