Suspect In Takeoff's Death Released From Jail After Paying $1 Million Bond
KEY POINTS
- The suspect for the murder of Migos member Takeoff was released from jail Tuesday
- Patrick Xavier Clark, the man charged with the murder, paid a $1 million bond
- Clark's plea for a bond reduction was denied last month by Harris County Judge Josh Hill
The suspect accused of murdering Migos member Takeoff is no longer behind bars.
Patrick Xavier Clark, the 33-year-old man charged with the murder of the late American rapper in a fatal shoot-out in Houston, Texas, last year, was released from Harris County jail Tuesday after paying the $1 million bond, according to CNN affiliate KRPC.
In December, Judge Josh Hill reportedly retained Clark's bond at the million-dollar rate, denying a reduction because the accused was a "flight risk."
"Neither Patrick nor his family posted the bond in this case. A concerned citizen and family friend who believes in Patrick's innocence posted the bond on his behalf," Clark's defense attorney Letitia Quinones said in a statement at that time, adding that the suspect "intends to comply fully" with the terms ordered by the court and "will appear for proceedings whenever the court requires him to do so."
"We believe Patrick is innocent, and at the appropriate time, the evidence will reveal that to be the case," she concluded.
Clark was arrested early in December, about a month after Takeoff, born Kirshnik Khari Ball, was shot and killed in Houston outside 810 Billiards & Bowling Houston after a private party, according to Rolling Stone.
The outlet learned a search warrant affidavit stated that out of all the individuals seen discharging the weapons in the reviewed video evidence, the suspect's position was the only one aligned with the angle at which Takeoff was "struck" before he fell to the ground.
A report obtained by Rolling Stone from the Harris County Medical Examiner determined that Takeoff's cause of death was "penetrating gunshot wounds to both his head and his torso."
At that time, Clark allegedly held a wine bottle during the shooting, which was used by the authorities to identify him as the suspect, after he left the item at the House of Blues, a music event venue in Houston, near the scene of the tragic shooting.
Clark reportedly fled to the area immediately after firing the shots, before returning to the bowling alley, and shortly after fled again, according to the surveillance footage descriptions. Fingerprints found from the wine bottle collected as evidence matched with Clark's.
Takeoff, a member of the platinum-selling rap group Migos along with his uncles Quavo and cousin Offset, died at 28. Police have ruled that the late rapper was unarmed and an "innocent bystander" to an argument that erupted outside the bowling alley.
When Judge Hill denied Clark's bond reduction last month, defense attorney Quinones reportedly argued that the million-dollar bond was "unconstitutional" and that the accused's financial situation was "average" and should be put into consideration, CNN reported.
But Harris County prosecutors contested, claiming that Clark should be considered a "flight risk," to which the lead judge agreed. In the motion filed by the prosecutors, they claimed that the suspect allegedly applied for an expedited passport, which was received before he got arrested. He was also found with a "large amount of cash money," the court filing added.
Prosecutors had requested that Clark surrender "any passports, visas, or other travel documents," be prohibited from leaving the premises of Harris County and be given a curfew.
Defense attorney Quinones revealed in a news conference after the court's bond decision that her office was "surprised" by the ruling, and they would continue to prove Clark's innocence in time.
"We complied with every requirement that the judge asked of us, only to be told today that it [the bond] would not be lowered. So yes, we are very disappointed. We disagree. And frankly, we're very surprised," Quinones said.
She continued, "The fight is not over. We do believe without a shadow of a doubt that when the time comes, we will be able to show Mr. Clark's innocence in this."
