Will Patent Dispute Between Apple and Samsung Affect Samsung Hercules Release?
Apple is pushing for a ban on Samsung Galaxy devices within two months, claiming they rip off the iPhone/iPad resemblances.
Samsung on the other hand has proposed a hearing date of October 14, suggesting that it can’t be so urgent since Apple delayed for months from inception of this case before filing its motion on these patents.
Apple had originally requested for an August 5 hearing, but it was dismissed by the judge as too soon. Apple's new proposal calls for a hearing on September 8, 2011.
Apple obviously wants to wane away the sales of iPhone/iPad rivals the Infuse 4G, Galaxy S 4G, Droid Charge, and Galaxy Tab 10.1.
As an observer I believe Samsung's attempt to play for time is very transparent, Patent blodder Florian Muller wrote in his blog, Also, Apple has already modified its schedule significantly, pushing back the proposed hearing date by about a month as compared to its motion. I also think Apple is quite right that the infringement allegations at issue are pretty straightforward, and Samsung should be able to respond to them reasonably soon.
The patent dispute between Apple and Samsung began in April when Apple sued Samsung for copying iPhone and iPad designs in its Galaxy range, which includes the Galaxy S 4G and Galaxy Tab.
Now, if Apple gets its way with a California court, Samsung Galaxy devices will be removed from shelves. Will this affect the release of Samsung Hercules, a potential rival of iPhone 5, which was about to come to the market on this September.
