A man in Oklahoma was arrested Friday for allegedly posing as a psychic to rape his daughter's 11-year-old friend, telling the minor that if she refused to have sex with him then her family "would get hurt or die."
Andrew M. Burns, 36, was taken into custody and charged with one count each of first-degree rape, forcible sodomy, first-degree rape by instrumentation, and soliciting a minor for indecent exposure/obscene material, Law&Crime reported.
Investigation into Burns started in August 2022, according to a probable cause affidavit obtained by the outlet.
The victim, who is identified in court documents as "S.S.," filed a complaint at the time alleging that she "had been raped three times by her friend's father Andrew Burns."
The victim reportedly told police that she was at the home of her friend, Burns' daughter, for a sleepover when she received a text message from a self-proclaimed psychic.
"Hi, This is Casey. I can tell the future, I am a psychic," the first message allegedly read. "If you don't make out or have sex with your friend's dad then your family members will get hurt or die."
Right after she received the message, Burns came into the room and claimed to have also received a message saying "almost the same thing," the victim told authorities.
The victim said Burns told her "he was sorry that this is happening and she believed him." He then allegedly asked the victim not to tell his daughter and instructed her to sleep on the couch that night.
The victim told police that later that night, Burns woke her up "aggressively" looking "scared-ish" and told her to go outside, take off her clothes and get in the backseat of his car, the affidavit stated.
Inside the vehicle, the victim said that Burns "started using his fingers on her crotch area," and she started to cry due to pain. She said Burns then "started using his mouth on it."
The victim said Burns stopped after she made up a story that his daughter was watching them through the window, and they quickly went back inside. The victim then received a message from "Casey" claiming that Burns' memory of the previous night had been erased.
The next incident allegedly happened during the summer of 2022, when Burns claimed to have received a message from a psychic named Elisa who "wanted them to make out in [Burns'] car." Burns allegedly assaulted the child again using his hands and mouth, and she again stopped the assault by claiming Burns' daughter was watching them.
The third alleged rape occurred around Aug. 4, 2022, during Burns' daughter's birthday party, which was also a sleepover.
Burns allegedly fetched the victim from her home about 30 minutes early and brought her to his house where they were alone together. Burns allegedly threatened the victim that he would hurt her brother if she refused, before proceeding to rape her, according to the affidavit.
The victim said she passed out as she couldn't breathe after Burns put his hand over her mouth. After regaining consciousness, the victim noticed that she was fully clothed.
Investigators said that one of the victim's friends supported the claims, telling them that she allegedly had seen the "weird" messages on the victim's phone and said the victim told her that Burns was "forcefully doing things to her."
Burns' daughter allegedly told investigators that she too received messages from psychics about the future and that they "were trying to get [the victim] drunk."
Burns denied all allegations at the end of August 2022. Investigators allegedly found several naked images of the victim on Burns' phone.
The victim told police she remembered taking the photos and sending them to Burns, alleging that her friend's father told her "she would be raped" if she did not send him the pictures.
Burns was booked at the Delaware County Jail and released after posting $100,000 bond.
