An Australian man was sentenced to three years imprisonment Tuesday after he broke his infant daughter’s leg while trying to make her poo and then waited for almost two hours before taking her to a hospital.

The incident took place on July 7, 2018 when the unnamed man was looking after his daughter as wife used the bathroom. A court heard that in an attempt to make the baby poo, the man began moving the infant’s legs as if she was pedaling a cycle. Suddenly, he heard a crack. The man contacted the infant’s grandparents and a nurse who was an acquaintance, before rushing her to a hospital.

The man told the doctor that the child was sitting facing away while doing the movement. However, the doctor did not accept the man’s description as “they would not expect that injury from what was described.”

The court heard that the father accepted responsibility and admitted that he “must've done it too hard” and he “didn't know his own strength sometimes.” The court was also told that the man cared for his wife with an intellectual disability.

Considering the fact that the man had no criminal history and he had entered an early guilty plea, Judge Anthony Rafter said, “The injury was very serious, fortunately for the child there are no ongoing issues.”

He pleaded guilty to grievous bodily harm and was sentenced to three years in prison with immediate parole release.
