Amber Heard Could Go To Jail If Convicted Of Perjury, First Amendment Attorney Claims

Amber Heard is unlikely to end up behind bars in her ongoing defamation trial in Virginia.
Depp sued his ex-wife for allegedly smearing his name and ruining his career after her 2018 op-ed about being a domestic violence survivor. Legal experts weighed in on what awaits the "Aquaman" star after the trial.
"You don’t go to jail as a result of a civil finding," First Amendment attorney George Freeman of the Media Law Resource Center told Fox News Digital. "The only way what happened so far in Virginia could lead to jail is if she’s accused and convicted of perjury, which there has been no official accusation of and which seems quite remote."
He noted that civil cases such as Depp and Heard's case are a he-said, she-said dispute often resulting from messy divorces. He added that in his 40 years as a First Amendment attorney, he has never seen a person charged with perjury in a civil case.
Meanwhile, several Twitter users accused Heard of committing perjury after admitting that she did not donate the entire $7 million divorce settlement she received from Depp, contrary to what she claimed in the U.K. when Depp sued the British tabloid The Sun for calling him a "wife-beater."
During the cross-examination, Depp's lawyer quoted Heard's statement in 2018, saying she had "donated the entire divorce settlement to charity" because she wanted "nothing" from it.
"Seven million in total was donated to, I split it between the ACLU and the Children's Hospital of Los Angeles," Vasquez quoted Heard as saying, and the actress confirmed it while on the stand.
According to Heard, she made the pledge the moment they reached the settlement. However, Vasquez argued that she did not donate the entire $7 million to the charities.
Heard corrected Vasquez, saying it was "incorrect" because she already pledged the entire divorce settlement money. Vasquez clarified that she wanted to know if the money was "donated" and not "pledged."
"I use pledge and donation synonymous with one another," Heard explained to Vasquez. The latter argued, "I don't use it synonymously," and asked Heard again if she donated the money, and the "Stepfather" star confirmed she has not donated it yet because Depp sued her.
Andrew Nicol, the British judge who heard Depp's libel case against The Sun, dismissed Depp's case, saying the "wife-beater" claim was "substantially true."
"I do not accept this characterization of Ms. Heard," he said in his ruling, pointing out that Heard donated the $7 million divorce settlement to charity, The New York Times reported. "Her donation is hardly the act one would expect of a gold-digger."
Following Heard's recent admission at the trial that the money was not yet donated, several accused her of committing perjury when she testified in the U.K.
"If all previous statements are admitted, then I just can't see how #AmberHeard avoids perjury in the cross-examination," Asjad Nazir tweeted.
"Amber heard committing perjury on numerous occasions and now caught on live tv. Will she face consequences for it? Probably not," another wrote.
"THEY GOT HER. AMBER HEARD COMMITTED PERJURY IN THE UK," another person added.
Meanwhile, Heard's supporters have continued to back her amid her legal battle against Depp.
"Really hope Amber wins her counter suit so at least something remotely beneficial will come from this for her. #IStandWithAmberHeard," one tweeted.
"She's rich she doesn't need money. She dated the richest man on the planet. I think she's good!! Lol. She was abused. Johnny thought she was an angel when she nursed him to health. She's not a nurse, she was his lover. #IStandWithAmberHeard," another added.
"Yes! They don’t believe any of her evidence, but easily believe his, when it’s not even consistent. It’s obvious some people just don’t care about the truth, they only want to hate on a woman and support a famous man. #IStandWithAmberHeard," a third person wrote.
Depp and Heard's defamation trial will continue Tuesday.
