A Lyft driver has been arrested for allegedly raping a tourist in Miami Beach during an early morning ride.
Kevyn Rojas, 26, was arrested Tuesday from his home for the alleged assault on the intoxicated woman that took place on Feb. 27.
The woman, visiting Miami Beach from Texas, told cops she was raped by the driver after she ordered a Lyft ride back to her hotel. She was drinking at a Wynwood bar on the night of Feb. 26 and booked her ride after feeling sick and puking outside the bar.
The arrest report said she got into the driver’s back seat at around 4:20 a.m. on Feb. 27. The victim noted that Rojas made a comment in Spanish about the blue dress she was wearing, according to Miami Herald.
The victim fell asleep on the way to the Berkeley Shore Hotel. She woke up to alert notifications from Rojas’ phone, saying they had reached the hotel. When she looked up, she said she could see that they reached the hotel; however, she said Rojas then began driving away.
The report said the driver drove around and parked the car at a spot before jumping into the backseat. The victim was still lying down when Rojas began sexually assaulting her, the report added.
Although the woman repeatedly told Rojas to stop, she was too drunk to fight him off, cops said.
Rojas eventually dropped the woman off at her hotel, where she called the police and reported the incident.
The arrest affidavit said investigators were able to identify the Lyft driver through the victim’s app as well as from surveillance cameras near the hotel.
The company said Rojas is no longer working for Lyft in light of the incident, according to CNN.
"The behavior described is appalling," a spokesperson said, according to the publication. "The driver has been permanently removed from the Lyft community, and we stand ready to assist law enforcement with their investigation in any way we can."
Rojas faces charges of sexual battery on a helpless victim, according to 7News. He appeared before a judge Wednesday morning.
“You’re not to drive for Lyft. I’m sure they won’t have you anyway after these allegations,” the judge reportedly said.
