Police said the man stomped on his one-month-old daughter as she laid on the floor. He then called his wife and informed her that the baby wouldn’t stop crying.

The unidentified teen was babysitting 49-year-old David Whelan’s daughter at his home when the incident took place.

It was revealed that the accused bonded out of jail on March 24 and returned to the home to find another man living with his girlfriend. He entered the home and found the two having sex following which he "lost it."

The infant was admitted to the Kaiser Permanente Redwood City Medical Center on Feb. 18 with serious injuries.

The suspect, who was on the electric home monitoring system for a previous driving under the influence arrest, was charged with attempted murder among other charges related to the assault and was booked into Kings County Jail.

The child was rushed to the hospital where she succumbed to injuries. Referring to the incident as an accident, officials said no foul play was involved.
